Freeman Products, Inc. Warrants its products only to the original purchaser of the product covered by this warranty. This warranty does not extend to any subsequent purchaser of such product or to any subsequent purchaser of the property on which this product is used. This warranty may not be enforced by any party other than the original purchaser of the product covered by this warranty.
Freeman Products, Inc. Warrants its products against defects in materials or workmanship appearing to the original purchaser within thirty (30) days of the date of delivery. Any claimed defect in material or workmanship shall be deemed waived unless submitted to Freeman Products, Inc. in writing within thirty (30) days from the date it was or by reasonable inspection should have been discovered.
Freeman Products, Inc. shall not be liable under this warranty if any loss or damage is caused by improper use or application of its product, or if its products are not applied and used according to Freeman Products, Inc.’s current printed directions and specifications, free copies of which are available upon request. This warranty does not apply if the product has been damaged by accident, abuse, misuse, modification or misapplication, or by damage during shipment.
Freeman Products, Inc.’s warranty is expressly limited to replacement (in the form originally shipped) of products not complying with this warranty, or at Freeman Products, Inc.’s election, to the repayment of, or crediting the original purchaser with any amount equal to the purchase price of its products. Freeman Products, Inc. shall not be liable in any case for special, incidental or consequential losses, damages or expenses, directly or indirectly arising from the sale, handling or use of its products due to breach of warranty, breach of contract, negligence, or any other legal theory, or any other cause related thereto. Such damages include, but are not limited to, loss of profits or revenue, loss of use of equipment, cost of capital, cost of any substitute equipment, facilities or services, downtimes costs, or claims of customers of the original purchaser for any damages.
THE FOREGOING WARRANTY IS IN LIEU OF AND EXCLUDES ALL OTHER WARRANTIES NOT EXPRESSLY SET FORTH HEREIN WHETHER EXPRESS OR IMPLIED BY OPERATION OF LAW OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. The agents, dealers and employees of Freeman Products, Inc. are not authorized to make modifications to this warranty, or additional warranties binding on Freeman Products, Inc. Accordingly, additional statements, whether oral or written, do not constitute warranties, and should not be relied upon.
No suit shall be brought on any alleged breach of this warranty more than twelve (12) months following delivery of any Freeman Products, Inc.’s products.
Some states do not allow limitations on warranties, or on any remedies for breach. In such states, the above limitations may not apply to you.
